- 1. This contract is entered into between
- and Payonce Property Maintenance (“Payonce”) in relation to the property at
- and is intended to be legally binding under the laws of the Commonwealth of Australia.
2. In consideration for Payonce providing unlimited handyman and trade maintenance services as required at the above property for a period of one year, the Landlord agrees to pay Payonce a nonrefundable fee of $1,980.00 (One Thousand Nine Hundred and Eighty Dollars)including GST upfront.
3. In consideration for payment of the fee set out in Clause 2, Payonce agrees to provide handyman and trade maintenance services to the Landlord, subject to Clause 4, 5 and 6.
4. Payonce is obligated to perform work in relation to any pre-existing damage or maintenance issues which are outlined in the Quality Report, promptly after the date of this agreement,and will conduct all repair and maintenance caused by accident or wear and tear during the course of the contract.
5. Payonce is obligated to provide maintenance services for 12 months from Commencement date.
6. Payonce acknowledges that if the Property is tenanted, unless instructed otherwise, it can act on requests by the tenant as if they were made by the Landlord or Real Estate Agent.
7. Payonce undertakes to provide handyman and trade maintenance services to a high professional standard regardless of the number of call outs to the property during the term of the contract.
8. Payonce is obligated to provide a report detailing the works conducted at the property to the Landlord or Real Estate Agent.
9. The parties acknowledge that Payonce is obligated to provide labour only, and that the Landlord must pay the cost of any equipment or materials required by Payonce to complete maintenance works. For the avoidance of doubt, presentation of a valid tax invoice in relation to a particular material or equipment will be considered proof of the cost of those funds and that they are owed to Payonce.
10. Payonce undertakes to maintain public liability insurance in the amount of at least $10,000,000.00 (Ten Million Dollars) throughout the course of the contract. A copy of Public Liability Insurance can be obtained on request.
11. The parties agree that notwithstanding any other provision of this contract, Payonce may at any time determine that it is unable to provide maintenance services to the Landlord at the Property under the “FAIR GO POLICY” and will refund a proportion of the fee paid to it, calculated on a pro rata basis.
12. The benefit of this agreement is not assignable by the Landlord, and the Landlord may not transfer the benefit of this contract to another Property without the written consent of Payonce. If such a transfer is agreed by Payonce, the Landlord must pay an inspection fee of $99.00 (Ninety-Nine Dollars) for the exchanged property.
13. Premium Membership Inclusions
Handyman Services
Annual smoke alarm test and battery change, minor plumbing (repair of leaking taps, replacing taps, shower heads, toilet flush), minor bricklaying and concreting, grouting, wall and floor tile repairs, mail box, cloth line, general plastering and painting, repair and install house/garage doors, windows, locks, fly screens, general carpentry, sealing baths and showers, repair of shower screens, towel and toilet roll bracket, soap holder, repairing kitchen and bathroom fittings, repairing carport, deck, supporting beams, pergolas, shelving, cabinet, sliding doors, fence and gate, general roof & guttering maintenance (not cleaning) and bi-annual inspection and repair.
Trade Services
Major plumbing, electrical issues related to wiring, power points, light switches, switch board, once a year general Internal Pest Control. NOTE: 1) Plumbing issues outside the building and Electrical issues beyond meter box are not covered. 2) Payonce will not take responsibility for blocked sewage or drainage pipes if found that any object or item has been placed there deliberately.
14. Membership Exclusions (not covered by this contract)
Any material, part, item which needs to be purchased or hired, repair of electrical/gas goods, mirrors, glass, gardening, cleaning or cosmetic repairs, carpet.
IMPORTANT: Payonce will not take responsibility for any repair that is the responsibility of the Body Corporation.
